Drug Testing Program

To remain compliant with DOT rules and regulations, all transportation companies or owner-operators with a Commercial Driver’s License (CDL) must follow necessary drug testing and policies and procedures.
DOT drug testing is a vital part of every transportation company. Every driver and employer with CDL – Commercial Driver License must follow drug testing procedures set by the USDOT and FMCSA. Drug testing rules govern the structural process specifying which driver or employer should undergo a drug test, when and how to administer the test, and more.

To remain DOT compliant, all commercial motor vehicle drivers must enroll in the following Drug tests. 

  1. Pre Employment Drug Test: Before operating a commercial vehicle, every CDL driver/company/owner-operator must enroll and complete a pre-employment drug test and get a negative test report.
  2. Post-Accident Drug Test: The type of test depends on the impact and the injuries sustained by the victims. A driver then has to undergo a drug and alcohol test to determine his(er) liability.
  3. Random Drug Test: Keeping self DOT compliant, owner-operator, and transportation employees of the companies must join a consortium pool and enroll for random drug and alcohol tests all round the year. Under DOT regulation 382.305, every CDL employer must comply with a minimum yearly ratio rate for random drug testing.
    As of January 1, 2020, the DOT set the limit of sudden/unplanned drug test percentage rate at 50%, and the spontaneous alcohol test percentage rate at 10% for motor carriers.
  4. Reasonable Suspect Drug Test:An employer has every right to call for a suspect drug test if the employer has a valid reason against an employee under the influence of drugs or alcohol during the working hours. The employee is answerable and can not deny such a call.
  5. Return-To-Duty Drug Test:If an employee is tested positive for drugs and alcohol, he should return with a damaging result report for a Return-to-duty drug test. And must be clean to get a negative return-to-duty result before resuming his work.
  6. Follow Up Drug Test:An employee who has completed a return-to-duty process (incorporate a negative return-to-duty test) must randomly test several times throughout the year.

The FMCSA requires mandatory drug and alcohol testing for every commercial motor vehicle driver. 50% of your fleet’s drivers must randomly test for controlled substances, and 10% must be randomly tested for alcohol every calendar year.  In this guide, learn about FMCSA drug testing requirements and how to keep your fleet compliant.
